Question:
When an employer uses surveillance of employees in workplace, is it compulsory by law for the employer to make a personal data collection statement to the employees about the surveillance?

Answer:
When it is decided to run a surveillance system in the workplace, the employer should start communicating with the employees about the things he may include in the personal data collection statement he is preparing, with a view to obtaining their understanding and cooperation. The employer should also see that the employees be properly informed of his personal data collection statement. He should review or amend the statement whenever necessary. The purpose of the statement is to ensure that the employees’ right to information be respected and exercised. The manner of surveillance should be clearly explained, as the employees have the right to know about what, why and how about their data to be collected. Forms of surveillance must be kept legal and proportionate. Secret surveillance is prohibited except where legal and disciplinary investigations are involved.
