Title: Transferring video signals of the traffic monitoring system to the Public Security Forces Affairs Bureau

    The Transport Bureau consulted the GPDP about streaming video signals of the traffic monitoring system to the Public Security Forces Affairs Bureau (DSFSM)

Result:

    Under its Articles 3 and 4(1)(1), the Personal Data Protection Act (Law 8/2005) regulates the data processing found in the current case. Due to the fact that the Transport Bureau (DSAT) did not provide adequate information, so GPDP could not make detailed analysis.
  According to the DSAT’s information, it was asked by the Fire Services Bureau (CB), for daily and emergency vehicle control, to steam out real-time traffic signals. GPDP believed that for such purpose the CB, need not and should not be informed of any personal data (including that governed by Articles 7 and 8 of the said Law), should only access the current traffic information. Therefore, data provided by the DSAT through the aforesaid signals should not include personal data, for instance, identifiable images of persons, license plates, etc (even legible images after tuning in the signals). In cases where the DSAT finds it necessary to provide, or the CB is necessary to examine the traffic information that contains personal data, the former shall ensure the data recipients have the legitimacy, set forth by Articles 6 to 8 of the same Law, as well as fulfilling the principles given in Articles 2 and 6 thereof, in particular the principle of proportionality.
  If the DSAT wishes to obtain recommendations on a specific case from the GPDP, it may submit the information as Article 23 of the Personal Data Protection Act stipulated. In addition, it may also explain the reasons as to provide, or not to provide, to the CB the data previously mentioned, in addition to justification for the data processing as given in Articles 2 and 5 of the same Law.
