Title: Install a CCTV surveillance system at home for security reasons

Resident X installed a video surveillance system at home for security reasons. In addition to family members, the domestic helper would also be monitored. X asked whether this practice conforms with the Personal Data Protection Act (Law 8/2005). |

According to the detailed information received, the GPDP made the following response:
Article 3(2) of the Personal Data Protection Act provides that the said Law does not apply to the processing of personal data carried out by a natural person in the course of a purely personal or household activity, and saving those with the purposes of systematic communication and dissemination.
As mentioned, the said Law does not apply to the processing therein, since X installed the video surveillance system for household security and will not use the images captured by the system for system communications or dissemination.
Since the domestic helper would be monitored by the system, she should be informed of it and the purposes of its installation. Furthermore, the monitoring area should not include toilets, bedrooms, etc. |
