標題: Providing the data of minors


    Bureau Y, for its investigation, required Bureau X to provide the educational status, residential address and telephone number of two minors. Bureau X consulted GPDP about the issue.


    In accordance with Articles 4(1)(1) and 3(1) of the Personal Data Protection Act (Law 8/2005), this Law regulates the data processing of the current case.
  Due to the limited information Bureau X provided, GPDP could not conduct detailed analysis and offer opinions. However, generally, Bureau X has to take into account whether Bureau Y possess the legitimacy as governed by Article 6 of the Law last mentioned to process the personal data of the two minors. Apart from the mentioned, before making any decisions, Bureau X should also examine its policies and if it has any obligations to transfer the said data.
  If Bureau X intends to obtain opinions on a specific case from GPDP, it should, according to Articles 23, 6 and 8 of the Personal Data Protection Act, justify if it possess, or not possess, the legitimacy of providing Bureau Y the said information. Along with the reasons Bureau X offered according to Articles 2 and 5 of the same Law, then GPDP could conduct further analysis.
